Sigma Lithium Says Operations Unaffected by Preliminary Court Ruling

Sigma Lithium Corporation has confirmed that its mining and industrial operations in Brazil remain fully operational despite reports of a preliminary judicial ruling that allegedly seeks to suspend the company’s environmental licenses. The company stated that it has not received any formal legal communication concerning the ruling and maintains that its activities continue without interruption.

The preliminary decision was reportedly issued by a court in Teófilo Otoni during a judicial recess and more than 300 kilometers from Sigma Lithium’s operations in the Vale do Jequitinhonha region. The company said the ruling was issued without following appropriate due process and believes it conflicts with Brazil’s established legal framework.

Sigma Lithium emphasized that it remains focused on expanding its production and advancing its operational plans. Following its recently announced agreement with Minas Gerais state authorities, known as the TAC Agreement, the company expects to produce approximately 240,000 tonnes of lithium oxide concentrate over the next 12 months and 330,000 tonnes during fiscal 2027.

According to the company, any potential daily fine associated with the preliminary ruling would become payable only if a final adverse judgment is issued following completion of the full legal process. This process would include opportunities for appeals through the appropriate federal courts and higher judicial authorities. Sigma Lithium said similar legal cases in Brazil can take several years to reach final resolution, meaning it does not currently expect any payments or enforcement actions.

The company also rejected media reports suggesting that the preliminary ruling could override its comprehensive TAC Agreement with Minas Gerais authorities. Sigma Lithium said it has consistently maintained transparent communication with federal, state and municipal authorities and has supplied extensive technical, environmental and operational evidence supporting its activities.

The company highlighted its environmental and social sustainability initiatives in the Vale do Jequitinhonha region, where it has operated since 2012. Its practices include dry stacking of tailings without conventional tailings dams, water reuse, reduced dust and noise levels, and rehabilitation of mining areas through vegetation.

Sigma Lithium also noted its contribution to Brazil’s growing role in the global lithium supply chain. Its operations supply lithium oxide materials used by battery producers and support applications including energy storage and energy security.

The company expects to begin its formal legal defense once Brazilian courts resume regular operations after the judicial recess. Until then, Sigma Lithium warned that inaccurate reports concerning its business could continue to create uncertainty around its operations and regulatory position.

Chemical Commodity Price Impact

The news is broadly supportive for lithium oxide concentrate and spodumene-based lithium supply, as Sigma Lithium indicates that production remains uninterrupted and expansion targets are intact. Continued operations should help maintain regional lithium availability and reduce concerns about near-term supply disruption from Brazil. For chemical commodities tracked by ChemAnalyst, the immediate impact on lithium carbonate and lithium hydroxide prices is likely limited to mildly bearish or stable, as uninterrupted Brazilian concentrate production supports downstream feedstock availability. However, uncertainty surrounding the environmental-license dispute could introduce short-term market volatility. If operations remain unaffected and planned volumes materialize, sustained supply growth could place moderate downward pressure on lithium chemical prices.
