Orbia Advance Corporation announced that the Amsterdam District Court has dismissed two major lawsuits filed against the company and its subsidiary, Vestolit GmbH, as part of the Dutch Ethylene Damages Litigation. The cases, brought by Shell Chemicals Europe and a Dutch foundation representing three Spanish and Portuguese entities of Repsol, sought damages exceeding €1 billion. The court concluded that neither plaintiff had sufficiently demonstrated that they suffered financial harm due to the alleged conduct.
The rulings mark the first decisions among 13 lawsuits linked to a 2020 settlement between several companies and the European Commission concerning the ethylene market. According to the court, the Repsol claim failed because it was not plausible that the alleged conduct caused any measurable damage. Similarly, Shell’s case was dismissed after the court determined that the company had not provided convincing evidence that it had incurred losses.
Orbia and Vestolit welcomed the judgments, emphasizing that the court conducted a detailed review of the facts and available evidence before reaching its conclusions. The court also noted that the substantial rise in steam cracker margins during the period under review suggested that ethylene suppliers experienced stronger profitability, indicating that the alleged actions had no meaningful impact on market prices or supplier earnings.
Sheldon Hirt, General Counsel at Orbia, stated that the company has consistently argued that the claims lacked merit because the alleged conduct did not influence the prices charged by ethylene suppliers. He added that the claimants benefited from favorable market conditions and oligopolistic pricing, enabling them to earn strong returns rather than incur losses.
Hirt also questioned the assertion that relatively small ethylene purchasers could manipulate market prices by as much as 50%, arguing that such a scenario was economically unrealistic. He pointed out that many of the companies pursuing damages are also significant buyers of ethylene, giving them extensive knowledge of market conditions and production cycles. According to him, any future legal proceedings should closely examine the actual functioning of the ethylene market and the reasons supplier profit margins increased during the period in question.
The company described the ruling as a positive outcome not only for Vestolit but also for smaller participants in the European chemical industry and downstream consumers. Orbia reaffirmed its intention to continue defending itself against the remaining lawsuits, maintaining that all outstanding claims are without merit and should also be dismissed through the legal process.

The court's decision is unlikely to have any immediate impact on ethylene production, supply, or downstream product availability, as the ruling concerns legal liability rather than manufacturing operations or market fundamentals.
